These Terms of Service govern your use of the services provided by Vargas Fencing Construction. By requesting an estimate, scheduling, or using our services, you agree to these terms.

1. Services

Vargas Fencing Construction provides professional residential and commercial fencing services, including vinyl fence installation, wood fence installation, aluminum fence installation, fence replacement, fence repairs, emergency fence repairs, and related fencing services as described through our website, promotional materials, or direct communication.

Service availability may vary depending on location, weather conditions, material availability, scheduling, and site accessibility.

2. Estimates, Scheduling & Cancellations

We proudly provide free estimates for all prospective projects.

Project dates are scheduled upon acceptance of an estimate and are subject to availability. Customers are asked to provide at least 24 hours' notice if they need to reschedule a scheduled installation or repair.

If a project cannot proceed due to inaccessible work areas, unsafe conditions, or customer-related delays, Vargas Fencing Construction reserves the right to reschedule the project and, where applicable, charge reasonable fees for lost labor or materials.

In the event of severe weather or unsafe working conditions, we may postpone work to protect the safety of our team and customers.

3. Pricing & Payments

Project pricing is provided through a written estimate based on the scope of work, materials, labor requirements, and site conditions.

Any requested changes after work has begun may require a revised estimate and additional charges.

Payment terms will be outlined in your estimate or project agreement. Final payment is due according to the agreed payment schedule unless otherwise stated in writing.

4. Customer Responsibilities

Customers are responsible for ensuring reasonable access to the work area throughout the project.

Property owners should disclose underground utilities, easements, property line concerns, HOA requirements, permitting requirements, or any conditions that could affect installation before work begins.

Customers are also responsible for securing pets and removing personal belongings from the work area before scheduled service.

5. Liability

Vargas Fencing Construction performs all work using professional standards and quality materials.

We are not responsible for pre-existing property damage, inaccurate property line information provided by others, underground utilities that were not properly identified, hidden site conditions, or delays caused by weather, permitting, material shortages, or circumstances beyond our reasonable control.

While we strive for timely completion, estimated completion dates are not guaranteed due to factors outside our control.

6. Warranty & Satisfaction

Customer satisfaction is important to us.

If you have concerns regarding workmanship, please notify us within 7 days of project completion so we may inspect the work and reasonably address any workmanship-related issues.

Manufacturer warranties on fencing materials remain subject to the manufacturer's individual warranty terms.

7. Refusal or Termination of Service

Vargas Fencing Construction reserves the right to refuse or discontinue service if job site conditions are unsafe, hazardous, inaccessible, unlawful, or otherwise unsuitable for safe project completion.

8. Governing Law

These Terms of Service shall be governed by the laws of the State of Florida.
